Just after 3:15 p.m. on Saturday, Oct. 27, Walmart APA John Rouston called to report a man he had located inside the store. The man, later identified as Patrick Badgett, 60, Louisville, Kentucky, had left with a woman, Lauren Dizney, 22, Salem, through the lawn and garden section and hadn’t paid for their merchandise. Furthermore, Badgett had been trespassed from Walmart in the past.

Salem Officers James Moore, Allison Garloch and State Trooper Kyle Taylor entered the store and found Rouston speaking with Badgett. Moore detained Badgett and Taylor spoke with Dizney, who was standing by the car in the parking lot near the lawn and garden section. After Taylor read her the PIRTLE warning (asking for consent before searching a home, property or vehicle without a search warrant), Dizney granted consent to search her bag located in the vehicle and told Taylor the Pokémon hat she had taken without paying was in the back seat of the vehicle.

Taylor returned the hat to Walmart employees and Moore and Rouston took Dizney and Badgett to Rouston’s office. While searching through Dizney’s bag, Garloch located two syringes, one of which was loaded with a clear substance that field-tested positive for methamphetamine, and a round, white pill identified as Odansetron Hydrochloride, a prescription-only medication.

Rouston requested officers impound the vehicle from the parking lot and Taylor conducted an inventory of the vehicle. He found a clear bag containing a folded paper with a crystalline substance inside, later identified as methamphetamine, in the center console and a straw cut in half with methamphetamine residue on the floor near the driver seat.

During the book-in process, Taylor requested the Indiana State Police check Badgett’s criminal history and he had several charges dating back to June 17, 1980, relating to theft.

Badgett was preliminarily charged with: possession of methamphetamine (pled, awaiting sentence), possession of a syringe, possession of paraphernalia, theft and criminal trespass.

Dizney was preliminarily charged with: possession or use of a legend drug or precursor, possession of methamphetamine, possession of a syringe and theft.
